When soft regulation is not enough: The integrated pollution prevention and control directive of the European Union

Abstract Recent debates regarding the effectiveness of regulatory policymaking in the European Union (EU) focus on the merits of soft, non-binding forms of regulation between public and private actors. The emergence of less coercive forms of regulation is analyzed as a response to powerful functional pressures emanating from the complexity of regulatory issues, as well as the need to secure flexibility and adaptability of regulation to distinctive territorial economic, environmental, administrative, and social conditions. In this article we empirically assess the above normative claims regarding the effectiveness of soft regulation vis-à-vis uniformly binding legislation. We draw on an exploratory investigation of the application of the Integrated Pollution Prevention and Control Directive of the EU in four countries. Our study reveals that effectiveness in the application of soft policy instruments is largely contingent upon strong cognitive, material, and political capacities of both state regulators and industrial actors involved in regulatory policymaking. In the absence of those conditions, the application of soft, legally non-binding regulation may lead to adverse effects, such as non-compliance and the "hollowing out" of the systems of environmental permits to industry. In the medium term, such developments can undermine the normative authority of the EU. [source]

This essay evaluates the implications of international political development on demographic transitions and economic outcomes from 1980 to 2050. Countries with high levels of political capacity experience the sharpest declines in birth and death rates as well as the greatest gains in income. Politics indirectly and directly affects the environment within which individuals make decisions about the size of families; these decisions, in turn, change the future economic dynamics of a country. We find that political capacity ensures that rules are evenly applied, allowing investment for long-term gain. Our projections show that under conditions of high political capacity, anticipated demographic and economic transformations will allow China to supersede the dominance of the United States by the end of this century and will also enable the rise of India into the ranks of the dominant powers. Democracy and decentralisation: local politics, marginalisation and political accountability in Uganda and South Africa

Abstract While democratic decentralisation is viewed as an important vehicle for development in sub-Saharan Africa, its viability in practice is often doubted. Lack of resources, expertise, marginalised populations and the inexperience of local electors are all barriers to successful decentralisation. However, often overlooked are the diverse ways in which local people use the opportunities provided by democratic decentralisation to engage local authorities and demand accountability. Using examples from Uganda and South Africa,1 this article demonstrates how local people use democratic openings to meet the challenges of marginalisation and demand accountability. While the data is from the mid to late 1990s, the evidence presented here is relevant to the continuing debate over democratic decentralisation for it reveals something that is not always recognised: lack of resources is not necessarily the problem; developing political capacity for demanding accountability for existing resources is what is important. The implication is that for decentralisation to be effective, practitioners must develop a better understanding of local political engagement so that their efforts may strengthen rather than thwart emerging political relations of accountability.
