Selected AbstractsThe Enjoyment of Rights and Freedoms: A New Conception of the ,Ambit' under Article 14 ECHRTHE MODERN LAW REVIEW, Issue 5 2006Aaron Baker, Article first published online: 16 AUG 200 Article 14 of the European Convention on Human Rights, as applied by the UK judiciary under the Human Rights Act 1998, is in danger of becoming as ,parasitic' as it is often described. Judges have inappropriately narrowed the scope of the ,ambit' of other Convention articles, and thus limited the number of claims to which Article 14 can apply, by defining it according to considerations more properly weighed in a justification analysis incorporating proportionality. The emerging approach departs from Strasbourg jurisprudence, and fails to give full effect to the language and intent of Article 14. This trend need not continue. This article begins the process of fashioning a new conception of the ambit of Convention articles: one that could change the fortunes of Article 14 cases in the UK, but that flows naturally from the precedents of the European Court of Human Rights, and gives effect to the spirit of the HRA. BRAW ABSTRACT It is widely agreed that a new conception of history was developed in the early nineteenth century: the past came to be seen in a new light, as did the way of studying the past. This article discusses the nature of this collective revision, focusing on one of its first and most important manifestations: Ranke's 1824 Geschichten der romanischen und germanischen Völker. It argues that, in Ranke's case, the driving force of the revision was religious, and that, subsequently, an understanding of the nature of Ranke's religious attitude is vital to any interpretation of his historical revision. Being aesthetic-experiential rather than conceptual or "positive," this religious element is reflected throughout Ranke's enterprise, in source criticism and in historical representation no less than in the conception of cause and effect in the historical process. These three levels or aspects of the historical enterprise correspond to the experience of the past, and are connected by the essence of the experience: visual perception. The highly individual character of the enterprise, its foundation in sentiments and experiences of little persuasive force that only with difficulty can be brought into language at all, explains the paradoxical nature of the Rankean heritage. On the one hand, Ranke had a great and lasting impact; on the other hand, his approach was never re-utilized as a whole, only in its constituent parts,which, when not in the relationship Ranke had envisioned, took on a new and different character. This also suggests the difference between Ranke's revision and a new paradigm: whereas the latter is an exemplary solution providing binding regulations, the former is unrepeatable. Vitzthum Abstract Human reproductive ecology (HRE) is the study of the mechanisms that link variation in reproductive traits with variation in local habitats. Empirical and theoretical contributions from biological anthropology, physiology, and demography have established the foundation necessary for developing a comprehensive understanding, grounded in life history theory (LHT), of temporal, individual, and populational variation in women's reproductive functioning. LHT posits that natural selection leads to the evolution of mechanisms that tend to allocate resources to the competing demands of growth, reproduction, and survival such that fitness is locally maximized. (That is, among alternative allocation patterns exhibited in a population, those having the highest inclusive fitness will become more common over generational time.) Hence, strategic modulation of reproductive effort is potentially adaptive because investment in a new conception may risk one's own survival, future reproductive opportunities, and/or current offspring survival. The hypothalamic-pituitary-ovarian (HPO) axis is the principal neuroendocrine pathway by which the human female modulates reproductive functioning according to the changing conditions in her habitat. Adjustments of reproductive investment in a potential conception are manifested in temporal and individual variation in ovarian cycle length, ovulation, hormone levels, and the probability of conception. Understanding the extent and causes of adaptive and non-adaptive variation in ovarian functioning is fundamental to ascertaining the proximate and remote determinants of human reproductive patterns. In this review I consider what is known and what still needs to be learned of the ecology of women's reproductive biology, beginning with a discussion of the principal explanatory frameworks in HRE and the biometry of ovarian functioning. Turning next to empirical studies, it is evident that marked variation between cycles, women, and populations is the norm rather than an aberration. Other than woman's age, the determinants of these differences are not well characterized, although developmental conditions, dietary practices, genetic variation, and epigenetic mechanisms have all been hypothesized to play some role. It is also evident that the reproductive functioning of women born and living in arduous conditions is not analogous to that of athletes, dieters, or even the lower end of the "normal range" of HPO functioning in wealthier populations. Contrary to the presumption that humans have low fecundity and an inefficient reproductive system, both theory and present evidence suggest that we may actually have very high fecundity and a reproductive system that has evolved to be flexible, ruthlessly efficient and, most importantly, strategic. [source] Self-Deception and Moral ResponsibilityRATIO, Issue 3 2004Neil Levy The self-deceived are usually held to be moral responsible for their state. I argue that this attribution of responsibility makes sense only against the background of the traditional conception of self-deception, a conception that is now widely rejected. In its place, a new conception of self-deception has been articulated, which requires neither intentional action by self-deceived agents, nor that they posses contradictory beliefs. This new conception has neither need nor place for attributions of moral responsibility to the self-deceived in paradigmatic cases. Accordingly, we should take the final step toward abandoning the traditional conception, and drop the automatic attribution of responsibility. Kane MB Abstract Introduction: Innovative technology has led to high-precision radiation therapy that has dramatically altered the practice of radiation oncology. This qualitative study explored the implementation of this innovation into practice from the perspective of the practitioners in a large academic radiation medicine program and aimed to improve understanding of and facilitate the educational process of this change. Methods: Multiprofession staff participated in a series of seven focus groups and nine in-depth interviews, and the descriptive data from the transcripts were analyzed using grounded theory methodology. Results: Practitioners believed that there had been a major effect on many aspects of their practice. The team structure supported the adoption of change. The technology changed the way the practices worked. Learning new skills increased workload and stress but led to a new conception of the discipline and the generation of new practice-based knowledge. When the concepts were examined longitudinally, a four-step process of learning was identified. In step 1, there was anxiety as staff acquired the skills to use the technology. Step 2 involved learning to interpret new findings and images, experiencing uncertainty until new perspectives developed. Step 3 involved questioning assumptions and critical reflection, which resulted in new understanding. The final step 4 identified a process of constructing new knowledge through research, development, and dialogue within the profession. Discussion: These findings expand our understanding of how practice-based learning occurs in the context of change and can guide learning activities appropriate to each stage. [source] Think Locally, Act Globally: Toward a Transnational Comparative Politics,INTERNATIONAL POLITICAL SOCIOLOGY, Issue 2 2010Terrence Lyons Political dynamics and outcomes around the globe have been transformed by globalization, new patterns of human mobility, and the development of innovative transnational social networks. These new political processes are rooted in communities and networks that are not restricted by geographic location. Although politics has been delinked from territory in this way with regard to processes and actors, this does not mean that transnational politics focuses exclusively on universal issues or global approaches to social justice. Rather much of the new transnational politics is intensely focused on specific locations, identities, and issues (for example, "globalized" neighborhood associations, ethnicities, patrimonialism). Transnational politics also includes new conceptions and practices of citizenship and accountability (for example, legislative seats reserved for expatriate labor migrants) as the body politic becomes increasing mobile, political affinities delinked from geographic proximity, and critical constituencies reside outside of the territory of the state. Stimulated by criticisms of classical conceptions of sovereignty in systemic theories of politics, scholars returned to sovereignty as a topic of inquiry in the late 1980s and early 1990s. Their studies are finally bearing fruit. This essay focuses on the new conceptions of sovereignty that are emerging and (1) discusses the fundamental nature of sovereignty, (2) reviews the classical perspective on sovereignty, (3) surveys new constructivist alternatives to this classical view, (4) examines important new work on the problematic nature of sovereignty, (5) identifies continua of hierarchic relationships that make sense of the various forms of mixed or restricted sovereignty that we observe in world politics, and (6) argues why it is important to study alternative, hierarchic relationships in international relations. The principal themes throughout are that sovereignty is far more problematic than recognized in the classical model, that important elements of hierarchy exist in the global system, and that both our theories and practice of international politics would be improved by explicitly incorporating variations in hierarchy. [source] Judicial diversity, the woman judge and fairy tale endingsLEGAL STUDIES, Issue 1 2007Erika Rackley The story of the woman judge as one of exclusion and isolation plagued with allegations of bias is well documented. Interestingly, despite significant differences in time and place, a common theme unites these tales: the woman judge is a dangerous outsider, a threat to the aesthetic norm. The judicial climate, at least in most of the common law world, is somewhat chilly: reactions to her presence on the bench vary from the largely indifferent to the downright hostile. Why is this? After all, most people, perhaps acknowledging the political and democratic gains underlying calls for a more representative judiciary, would wish to encourage , or at least not discourage , judicial diversity. Taking the stories of the woman judge as its starting point, this paper contends that underlying these tales is an image of the judge that is as much intuitive as it is reasoned; that our understanding of the judge and judging is as much derived from the imagination as from what is conventionally considered as rational thought. Thus, the paper deploys the narrative strategies of fairy tales in an attempt to disrupt the imaginative hold of familiar yet particular images that infuse and distort current discourses on adjudication. It suggests that despite the Department for Constitutional Affairs' ongoing quest to increase diversity within the judiciary, current initiatives do not confront fully these instinctive images. As a result, their narrative of inclusiveness and difference fails. In response, the paper appeals to the imagination as a route toward engendering new conceptions on the judge and judging, the possibility of truly diverse judiciaries and, perhaps, a fairy tale ending to the woman judge's story.
