The effectiveness and efficiency of corporate insolvency law,part two

Little empirical research has been done in the Netherlands (or internationally) into the effect of corporate insolvency proceedings. The Dutch legislature has made several attempts in the past decades to revise the current Dutch Bankruptcy Act (Faillissementswet) of 1893, while almost nothing is known about the effectiveness and efficiency of the Dutch corporate insolvency law. I have studied the effectiveness of the current Dutch insolvency law and of European Directive 2001/23/EC which is incorporated in this law, on the basis of theoretical and large-scale empirical research. The study concerned all 4167 of the corporate insolvencies that ended in 2004. In the first part of this Article (International Insolvency Review, Volume 17, 3, Winter 2008, pp. 189,209), the research results showed that the Dutch Bankruptcy Act achieved the goals set on it only to a limited degree and that the informal restructuring procedure is of great social importance. In this second part, I concentrate on the conditions imposed by European Directive 2001/23/EC on the European national legislatures to protect employees' rights: automatic transfer of employment contracts in the event of transfers as part of insolvency proceedings, together with measures to prevent misuse of insolvency proceedings in such a way as to deprive employees of the rights provided for in this European Directive. The study shows that, in the Netherlands, not applying automatic transfer of employment contracts when an undertaking or business is transferred as part of an insolvency proceeding does not result in large-scale misuse of insolvency law. It appears that automatic transfer of employment contracts outside insolvency proceedings can actually impede the informal restructuring of financially unsound companies. Bringing Economic Interests Back into the Study of EU Trade Policy-Making

Studies of EU trade policy-making often suggest that delegation of trade authority from the national to the European level strengthened the autonomy of public actors in formulating trade policies. Little empirical research, however, has been undertaken to corroborate this contention. To improve on this situation, I carry out two case studies of the EU's participation in the multilateral trade negotiations known as the Kennedy Round (1964,67) and the Doha Development Agenda (2001 onwards). The analysis reveals that in both cases the EU's negotiating position was largely in line with the demands voiced by economic interests. Although this finding is no proof of economic interests actually determining EU trade policies, it casts some doubt on the autonomy thesis. I also discuss some factors that indicate that interest group influence may be the most plausible explanation for the finding. [source]


Is There Conceptual Convergence in Entrepreneurship Research?

A Co-Citation Analysis of Frontiers of Entrepreneurship Research
Conceptual convergence is often seen as a holy grail in entrepreneurship research. Yet little empirical research has focused specifically on the extent and nature of this convergence. We address this issue by content-analyzing the networks of co-citation emerging from the 20,184 references listed in the 960 full-length articles published in the Frontiers of Entrepreneurship Research series between 1981 and 2004. Our results provide evidence for the varying levels of convergence that have characterized entrepreneurship research over the years, as well as the evolution of the conceptual themes that have attracted scholars' attention in different periods. In addition, we provide evidence that the field relies increasingly on its own literature, something that points toward the unique contribution that it makes to the management sciences. [source]


Punishment as restoration of group and offender values following a transgression: value consensus through symbolic labelling and offender reform

Justice theory has suggested that transgressions pose a threat to the shared values that underlie broken rules or laws, suggesting that in order to address concerns over the values violated by an offence, perceived consensus regarding those values must be reaffirmed. However, little empirical research has been conducted examining how legal responses can address those value concerns. In the current research we argue that punishments, as a common response to injustice, can reaffirm perceived value consensus through two routes: (1) by symbolically labelling the offence as against group values, thus reinforcing values towards observers and (2) by attempting to reform the offender, thus reinforcing values towards the offender. Consistent with this argument, three empirical studies showed that the public and inclusive nature of punishment helps restore a perceived value consensus as such characteristics facilitate these two processes. Moreover, these characteristics had a positive effect on perceived punishment appropriateness particularly when value concerns were heightened. These findings implicate symbolic labelling and offender reform as two processes by which punishments can restore the perception of value consensus and suggest that these processes are integral to justice restoration through punishment when value consensus is a dominant concern. The influence of framing on attitudes toward diversity training

Although diversity training is becoming an integral component of organizations, little empirical research on the topic exists. The study examined here investigated how framing of diversity training (title, focus of content, assignment) and gender influenced participants' attitudes. In this study, 160 adults (72 men, 88 women; 124 white; 36 minority) read a diversity course description and answered questions assessing their attitudes about the course and the organization. Results revealed that (1) a frame with a traditional title and a broad focus was responded to most favorably by participants, (2) men reacted more negatively than women to the diversity training course, and (3) men reacted more negatively than women to a frame with a narrow focus and remedial assignment. Findings are discussed in terms of the effect that different frames can have on participants' pretraining attitudes toward diversity training. Implications for researchers and consultants are also discussed. [source]


IT project managers' construction of successful project management practice: a repertory grid investigation

Abstract Although effective project management is critical to the success of information technology (IT) projects, little empirical research has investigated skill requirements for IT project managers (PMs). This study addressed this gap by asking 19 practicing IT PMs to describe the skills that successful IT PMs exhibit. A semi-structured interview method known as the repertory grid (RepGrid) technique was used to elicit these skills. Nine skill categories emerged: client management, communication, general management, leadership, personal integrity, planning and control, problem solving, systems development and team development. Our study complements existing research by providing a richer understanding of several skills that were narrowly defined (client management, planning and control, and problem solving) and by introducing two new skill categories that had not been previously discussed (personal integrity and team development). Analysis of the individual RepGrids revealed four distinct ways in which study participants combined skill categories to form archetypes of effective IT PMs. We describe these four IT PM archetypes , General Manager, Problem Solver, Client Representative and Balanced Manager , and discuss how this knowledge can be useful for practitioners, researchers and educators. A model of information systems development project performance

abstract. Performance in information systems development (ISD) projects can be critical to business success. But, while project performance has been the subject of much debate, there has been little empirical research into its determinants. A survey of IS projects in the UK and New Zealand is analysed to test hypotheses concerning performance in terms of both project completion and budget (time-cost) variances. Subsequently, a secondary analysis of the findings is used to build a more complete empirical model of project performance. The paper helps to develop the theory of IS development project performance and also has significant implications for practice. Discussion of the findings highlights the importance of project team dynamics, risk management, senior management support for strategic projects and user participation in ensuring successful IS project performance. Possible selves and borderline personality disorder

Although clinical theories suggest that people with Borderline Personality Disorder (BPD) experience a confused sense of self, little empirical research has directly examined the self in BPD (Heard & Linehan, 1993; Westen & Cohen, 1993). In this study, 43 female participants, 15 with BPD and 28 without BPD, completed the closed-ended version of Markus and Wurf's (1987) Possible Selves Questionnaire (PSQ). Participants with BPD were less likely than controls to endorse positive possible selves as current, but more likely to endorse negative possible selves as current, probable, desired, and important. Participants with BPD linked negative and positive selves to their desired selves, which is consistent with the unstable sense of self characteristic of BPD. © 2005 Wiley Periodicals, Inc. Empowerment and peer support: structure and process of self-help in a consumer-run center for individuals with mental illness,

Personal empowerment is a guiding philosophy of many mental health service programs, but there has been little empirical research on the empowerment process in these programs. The authors examine social processes and consumer orientations within a self-help drop-in center for individuals with psychiatric disabilities, using intensive interviews and focus groups. They investigate motives for consumer involvement, bases for program retention, and processes of participant change. Motives for involvement in the center were primarily instrumental, whereas the bases of retention were more often maintaining social support and developing self-esteem. Participants valued the center's nonstigmatizing environment and its supportive consumer staff. Some used the opportunity to become a staff member to move into a more normalized social role; all seemed to derive benefits from helping peers. There were indications of some staff members adopting a more authoritarian posture, but participants repeatedly lauded most staff for their supportive orientation. Multiple Justiciable Problems: Common Clusters and Their Social and Demographic Indicators

Justiciable problems do not always occur in isolation. However, little empirical research has examined multiple problems in depth by identifying common clusters of problems, their extent, and those who experience them. The Legal Services Research Centre's Periodic Survey of Justiciable Problems is a large-scale survey undertaken in England and Wales, documenting 5,611 respondents' experience of 21 discrete problem categories. Having assessed the overall incidence and overlap of problem types, hierarchical cluster analysis, based on each respondent's experience of these categories, was used to identify clusters. We then established social and demographic predictors of each cluster using mixed-effects Poisson regression and examined each problem type's likelihood of overlapping with further problems, both within and between identified clusters. We highlight policy implications of our findings, particularly concerning developing "joined-up" solutions to multiple "joined-up" problems. [source]


An empirical investigation of Wal-Mart's expansion into food retailing

After revolutionizing the concept of mass merchandising with its Discount Stores, Wal-Mart has entered food retailing with its Supercenters, and has become the largest food retailer in the United States. Despite its relevance, little empirical research has focused on explaining the company's entry and expansion into food retailing. Wal-Mart's expansion into food retailing through its store conversion strategy is analyzed using an industrial organization entry framework. The results show that Wal-Mart's store conversion strategy has targeted largely populated areas with low population density, a high percentage of population receiving food stamps, and where the presence of incumbents is modest. The results also provide evidence that as the company moves toward saturation of local markets and increases store conversion rates, it may be forced to reconsider some of its strategic decisions based on the exploitation of economies of density and store conversion. © 2010 Wiley Periodicals, Inc. Leaders without ethics in global business: Corporate psychopaths

This paper introduces the concept of Corporate Psychopaths as ruthless employees who can successfully gain entry to organizations and can then get promoted within those organizations to reach senior managerial and leadership positions. What little empirical research currently exists supports the view that Corporate Psychopaths are more commonly found at senior levels of organizations. This paper presents further empirical evidence that supports this view. It discusses how, in a quantitative sample of 346 white-collar workers, in 2008, research using a psychopathy scale identified greater levels of psychopathy at more senior levels of corporations than at more junior levels. The paper goes on to propose that this is a universal issue that can pose various ethical problems for corporations because of the ruthless, selfish and conscience-free approach to life that Corporate Psychopaths have. Other ethical issues are to do with their moral accountability and with the problems associated with the possibility of screening employees for psychopathy. The paper reviews the literature on psychopathy and concludes that while psychopaths appear to be universal in occurrence, they may well be environmentally limited in their possible actions in more collectivist societies. However, the global spread of western, individualistically oriented corporations may pose a threat to any collectivist societies in which they operate. Copyright © 2010 John Wiley & Sons, Ltd. Understanding Attitudes toward Animal Use
Scientists have been portrayed as having an uncaring attitude toward the use of animals and being inclined to reject the possibility of animal mind (Baldwin, 1993; Blumberg & Wasserman, 1995), yet there is little empirical research to support these claims. We examined why disparate attitudes toward animal use are held. Scientists, animal welfarists, and laypersons (N = 372) were compared on questionnaire responses that measured attitudes toward four types of animal use, and factors that might underlie these views (including belief in animal mind). As expected, scientists and animal welfarists held polarized views on all measures, whereas laypersons fell between the two. Animal welfarists were consistently opposed to all types of animal use, whereas scientists expressed support for the use of animals for medical research, but not for dissection, personal decoration, and entertainment. Animal welfarists showed high levels of belief in animal mind for 13 animal types, and scientists believed some of the 13 animals to have at least a moderate capacity for cognition and most to have at least a moderate capacity for sentience. Hence, the negative image of the science community that is often portrayed was not supported by our data. Findings were discussed in relation to external (group membership) and internal (belief systems) factors, and it is concluded that some people hold fixed attitudes toward animal use, whereas others are more influenced by context. CORPORATE CITIZENSHIP AND URBAN PROBLEM SOLVING: THE CHANGING CIVIC ROLE OF BUSINESS LEADERS IN AMERICAN CITIES

ABSTRACT:,Our concern in this article is corporate civic elite organizations and their role in social production and urban policy in the United States. Recent urban literature has suggested that the power and influence of CEO organizations has declined and that there has been some disengagement of corporate elites from civic efforts in many urban areas. Yet while these trends and their likely consequences are generally acknowledged, relatively little empirical research has been conducted on the nature and extent of the shifts in corporate civic leadership and on how these shifts have affected the civic agendas of central cities and metropolitan regions. In this study we obtain data from 19 large metropolitan areas in order to more systematically examine shifts in corporate civic leadership and their consequences. Our results suggest that the institutional autonomy, time, and personal connections to the central cities of many CEOs have diminished and that the civic organizations though which CEOs work appear to have experienced lowered capacity for sustained action. These trends suggest that while many CEOs and their firms will continue to commit their time and their firms' slack resources to civic enterprises, the problems they address will differ from those tackled in the past. We discuss the important implications these shifts have for the future of corporate civic engagement in urban problem solving and for the practice of urban governance. [source]


LONGITUDINAL ANALYSIS OF DISPOSITIONAL INFLUENCES AND SEXUAL HARASSMENT: EFFECTS ON JOB AND PSYCHOLOGICAL OUTCOMES

Research consistently demonstrates that sexual harassment is related to a variety of negative outcomes. Negative outcomes, however, may be influenced by respondents' dispositions or response biases rather than by their sexual harassment experiences alone. This study investigates relationships between negative outcomes and sexual harassment over time in an attempt to assess this possibility. Further, little empirical research on sexual harassment has explored the impact of various coping strategies on experiences of harassment over time. Sexual harassment experiences, job-related and psychological outcomes, and coping responses were obtained from 216 female faculty and staff members at a midwestern university at 2 times, 24 months apart. Patterns of results suggests that sexual harassment has important effects on job-related and psychological outcomes that operate independently of dispositional influences or response biases. Results also indicate that sexual harassment at Time 1 is a better predictor of harassment at Time 2 than are coping strategies. [source]


Comparing factor analytical and circumplex models of brand personality in brand positioning

Competition has never been greater, which means it is more important than ever that organizations assess their brand management strategies, including brand personality management. However, little empirical research addresses the brand personality concept, particularly its role in product evaluation. An exception, which views brand personality as a set of human personality characteristics associated with a brand, has been criticized for its use of a factor analytical approach. An alternative approach posits that the brand represents a relationship partner with which the consumer may choose to engage; it corresponds to the interpersonal circumplex approach to personality modeling. The present study compares these two approaches by developing brand positioning maps and predicting consumer outcomes. The results support the factor approach in a purely quantitative sense, but the circumplex approach offers both a richer qualitative explanation of the findings by encompassing a broad spectrum of traits and a more diagnostic prediction of consumer outcomes. The Estimation of a Cusp Model to Describe the Adoption of Word for Windows,

This article revisits earlier work in this journal by Paul Herbig (1991) that proposed a catastrophe model of industrial product adoption under certain conditions. Catastrophe models are useful for modeling situations where organizations can exhibit both smooth and abrupt adoption behavior. It extends Herbig's work by focusing on organizations' adoption of new products when network externalities are an important part of the decision process, and it presents an empirical estimation of the model. Network externalities occur when firms do not want to adopt a new innovation or product unless other firms do. The reason is that they do not want to end up with an innovation that ends up not being a standard of some sort. Mistakes of this nature can be costly as the firm must invest twice and loses time relative to competitors who have not made such a mistake. However, when such externalities exist, for example with regard to technological adoptions, then normal diffusion gives way to sudden discontinuous shifts as all firms seemingly act together an move to a new technology. Since, technology is an area where the authors expect network externalities to exist, that is the focus of this article. The specific application is developed from two sets of panel data on the organizational adoptions of Microsoft's (MS) Word for Windows software by organizations that previously were using either Word for DOS or Word for Macintosh (Mac). The theoretical framework for the analysis is based on work in the economics literature on network externalities. However, the organization and new product development catastrophe model comes primarily from Herbig (1991). The article focuses on an area of organizational adoption where relatively little empirical research has been done, namely organizational adoption "for use." Longitudinal data provided by Techtel Corporation is used to develop the estimations. Results of the empirical analysis are consistent with the theoretical framework suggested in Herbig's article and in those found in economics and catastrophe theory literatures. This lends clear support to the idea that organizations will adopt a bandwagon-type behavior when network externalities are present. It further suggests that in such markets, the standard S-shaped diffusion curve is not an appropriate model for examining organizational behavior. From a managerial perspective, it means that buyers and sellers may face nonstandard diffusion curves. Instead of S-shaped curves, the actual curves have a break or rift where sales end, and there is a sudden shift to a new product that is relatively high very early on. Clearly, for new product development (NPD), it suggest that organizations' "for-use" purchases may be similar to regular consumers and may change rapidly from one product to another almost instantly, as in the case of the switch from vinyl records to compact discs (CDs). From an old product seller's viewpoint, the market is here today and gone tomorrow, while for the new seller it is a sudden deluge of sales requests. To put it in more everyday terms, sudden changes in adoption behavior are a September 11-type experience for the market. It is the day the world changes. [source]


Commercializing new technologies: consumers' response to a new interface

Successful commercialization of new technologies is the riskiest and most rewarding form of new product development activity. New technologies are often commercialized using innovative interfaces that determine how consumers interact with a new product to obtain its functionality. Consumers' perception of uncertainty about the performance of a novel interface is a key issue in the acceptance of new products involving new interfaces. Specifically, when firms commercialize a new interface, they face two major challenges: First to identify the optimal functionality for the new interface, and second, to effectively communicate with consumers in order to reduce uncertainty about the performance of the new interface and increase adoption intentions. Despite the theoretical and managerial importance of research on consumers' response to a novel interface, very little empirical research has been conducted in this area. Building on prior research on new product development, human-computer interaction, and consumer decision-making, this article examines the factors that influence consumers' judgments of uncertainty about the performance of a new interface and consumers' adoption intentions. Specifically, we conducted an experiment to investigate the effect of the newness of the functionality of a new product and the effect of imagery on consumers' uncertainty about the performance of a novel interface and consumers' adoption intentions. Our results show that consumers perceive lower uncertainty about the performance of a new interface and higher intentions to adopt a new product when the new interface is introduced with a new (vs. pre-existing) functionality. Furthermore, our results suggest that when a new interface is introduced with a new functionality, imagining the product in use increases consumers' uncertainty about the performance of the new interface and decreases their intention to adopt the new product. In contrast, when a new interface is introduced with a pre-existing functionality, imagining the product in use decreases consumers' uncertainty about the performance of the new interface and increases their intention to adopt the new product. Our findings provide valuable guidelines for marketers in formulating new product development and communication strategies for new products involving a new interface. © 2002 Elsevier Science Inc. A Loss of Faith: The Sources of Reduced Political Legitimacy for the American Medical Profession

Writing at the beginning of the 20th century, Shaw identified one of the significant contemporary transformations in industrial democracies. In part as the result of advances in science and technology, in part as a rejection of the monopolistic abuses of industrialization, and in part as a consequence of assiduous efforts by the professions themselves, this was a period in which the legitimacy and social authority of professionals increased dramatically (Brint 1994; Krause 1996; Larson 1977; Sandel 1996). Nowhere was this more evident than in medicine. Over several decades, medicine changed from an occupation with a mixed reputation and little political influence into one that would "dominate both policy and lay perceptions of health problems" (Freidson 1994, 31). In a number of countries, the professional authority and political influence of physicians also rose during this era (Coburn, Torrance, and Kaufert 1983; Krause 1996; Stone 1980), most dramatically in the United States (Starr 1982). The political legitimacy and policymaking influence of the medical profession have greatly declined in American society over the past 30 years. Despite speculation about the causes, there has been little empirical research assessing the different explanations. To address this gap, data collected in 1995 are used to compare attitudes of the American public and policy elites toward medical authority. Statistical analyses reveal that (1) elites are more hostile to professional authority than is the public; (2) the sources of declining legitimacy are different for the public than they are for policy elites; and (3) the perceptions that most threaten the legitimacy of the medical profession pertain to doubts about professional competence, physicians' perceived lack of altruism, and limited confidence in the profession's political influence. This article concludes with some speculations about the future of professional authority in American medicine. [source]


Unanswered questions: A preliminary investigation of personality and individual difference predictors of 9/11 conspiracist beliefs

Given the widespread appeal of conspiratorial beliefs, it is surprising that very little empirical research has examined the psychological variables associated with such beliefs. In the present study, we examined individual and demographic predictors of beliefs in conspiracy theories concerning the September 11, 2001 (9/11) attacks on the World Trade Centre and Pentagon among a representative British sample of 254 women and men. Results of structural equation modelling showed that 9/11 conspiracist beliefs were positively associated with belief in other conspiracy theories, exposure to 9/11 conspiracist ideas, political cynicism, defiance of authority and the Big Five personality factor of Agreeableness. In total, a model including demographics, personality and individual difference variables explained over 50% of the variance in 9/11 conspiracist ideas. Internal Wage Structures and Organizational Performance

This paper considers whether a hierarchical or compressed wage structure is positively associated with relatively high levels of organizational performance. To date, there has been little empirical research in this area (especially in the UK). Thus we present an operational measure of a compressed/hierarchical wage structure, using UK manufacturing micro,data in five industrial sectors, and examine its relationship with labour productivity. We find that the wage compression argument holds in one sector but not for the majority of sectors and that taking into account other, intra,industry characteristics, namely size and ownership differences, further weakens the relationship.
