Selected AbstractsThe Schengen Law: A Challenge for Legal Accountability in the European UnionEUROPEAN LAW JOURNAL, Issue 2 2002Daniel Thym This article examines challenges for accountability arising from the development of the Schengen law within the framework of the European Union. Building upon the substantive body of research by other authors on general implications of the integration of the Schengen acquis, it focuses on recent developments after the entry into force of the Treaty of Amsterdam and evaluates to what extent the European institutions have so far met the challenges for accountability stemming from the intergovernmental origin of the Schengen law. The article identifies various persisting deficiencies in the areas of transparency, institutional balance and judicial review and proposes specific actions, which should be addressed vigorously by the European institutions. Noonan Current trends intensify the longstanding problem of how the rule of law should be institutionalized in the welfare state. Welfare programs are being redesigned to increase their capacities to adapt to rapidly changing conditions and to tailor their responses to diverse clienteles. These developments challenge the understanding of legal accountability developed in the Warren Court era. This article reports on an emerging model of accountable administration that strives to reconcile programmatic flexibility with rule-of-law values. The model has been developed in the reform of state child protective services systems, but it has potentially broad application to public law. It also has novel implications for such basic rule-of-law issues as the choice between rules and standards, the relation of bureaucratic and judicial control, the proper scope of judicial intervention into dysfunctional public agencies, and the justiciability of "positive" (or social and economic) rights. Eijffinger The first part of this paper outlines the concept of democratic accountability of central banks, and compares the legal accountability of the European Central Bank (ECB) with some other central banks (Bank of Canada, Bank of Japan, Bank of England and the Federal Reserve System). The second part presents a theory of central bank accountability. Two aspects of accountability are considered: transparency of actual monetary policy and the question of who bears final responsibility for monetary policy. The paper shows that accountability through transparency leads to a lower expected rate of inflation and less stabilization of supply shocks. Accountability through shifting final responsibility in the direction of the government leads to higher inflationary expectations and more stabilization of supply shocks. Buiter (1999) critizes the ECB for its lack of democratic accountability, which he does not define in a very precise way. Issing (1999) replies to some of the points raised by Buiter and argues that the ECB is both accountable and transparent. [source] Public safety in private hands: A Study of Ontario's Technical Standards and Safety AuthorityCANADIAN PUBLIC ADMINISTRATION/ADMINISTRATION PUBLIQUE DU CANADA, Issue 1 2002Mark S. Winfield The authors place the tssa in the larger context of the restructuring of government functions and responsibilities and the transferring of these activities to non-governmental actors, as part of what has become known around the world as the "new public management." The history, rationale, mandate, structure and functions of the tssa are described. In addition, an assessment of the tssa as a model for the delivery of public services against criteria related to governance, political and legal accountability and performance relative to its predecessor is provided. The article concludes that significant gaps remain in the Ministry of Consumer and Business Services' capacity to adequately oversee the tssa and in the accountability framework for the tssa relative to that applicable to a conventionally structured government agency. Improvements in public safety outcomes in Ontario over the past decade are noted, although many of these trends pre-date the creation of the tssa and may be attributable to factors other than the mccr/tssa transition. Les auteurs placent la Esa dans le contexte plus vaste de la restructuration des fonctions et responsabilités gouvernementales et du transfert de ces activités à des organismes non gouvemementaux, dans le cadre de ce qui est maintenant connu mondialement sous le nom de « nouvelle gestion publique ». 11s décrivent l'historique, la justification, le mandat, la structure et les fonctions de la tssa. Ils foumissent en outre me évaluation de la Esa en tant que modèle de prestation de services publics selon des critères de gouvemance, d'imputabilité politique et légale et de rendement par rapport à son prédécesseur. L'article conclut qu'il existe encore d'importantes lacunes en ce qui concerne la capacité du ministère des Services aux consommateurs et aux entreprises à superviser adéquatement la tssa et en ce qui concerne le cadre de responsabilité de la tssa par rapport à ce qui s'applique à un organisme gouvernemental de structure conventionnelle.
