,The Perfect Business': Human Trafficking and Lao,Thai Cross-Border Migration

ABSTRACT Over the past few years some governments and development organizations have increasingly articulated cross-border mobility as ,trafficking in persons'. The notion of a,market,where traffickers prey on the ,supply' of migrants that flows across international borders to meet the ,demand' for labour has become a central trope among anti-trafficking development organizations. This article problematizes such,economism,by drawing attention to the oscillating cross-border migration of Lao sex workers within a border zone between Laos and Thailand. It illuminates the incongruity between the recruitment of women into the sex industry along the Lao,Thai border and the market models that are employed by the anti-trafficking sector. It discusses the ways in which these cross-border markets are conceived in a context where aid programming is taking on an increasingly important role in the politics of borders. The author concludes that allusions to ideal forms of knowledge (in the guise of classic economic theory) and an emphasis on borders become necessary for anti-trafficking programmes in order to make their object of intervention legible as well as providing post-hoc rationalizations for their continuing operation. Canadian Policy on Human Trafficking: A Four-year Analysis1

ABSTRACT This article introduces readers to Canadian Government policy and practice surrounding human trafficking since the adoption of the United Nations (UN) Protocol on Trafficking in 2000. After offering an overview of the UN Protocol, the article reviews and critically analyses Canada's efforts in the three key areas of the Protocol: prevention of human trafficking, protection of trafficking victims, and the prosecution of traffickers. Since the beginning of our research, progress has been made in Canadian policy responses. The Government began by developing and implementing its tools for the prosecution of traffickers, thereby responding to most of the prosecution recommendations of the UN Protocol. Different government agencies are also coordinating their efforts to implement prevention projects, both in source countries and at home, including awareness-raising campaigns, education campaigns, and policy development collaborations. However, the more structural elements of prevention have yet to be adequately addressed. Finally, without shifting their basic border control framework, Canadian government agencies are in the process of improving the protection of trafficking victims who are intercepted in law enforcement operations or who come forward for help. These protection measures would be strengthened further if migrants' rights were explicitly protected by law, something that has failed to occur given recent prioritization of crime and security. The formal protection of victims, as implemented to some degree in several European and American policies, is introduced for comparison. The article concludes with the remaining challenges that face Canadian policy makers, particularly in terms of shifting away from current focus on crime and security to the protection and promotion of the human rights of trafficking victims. LA POLITIQUE CANADIENNE EN MATIÈRE DE TRAITE DES ÊTRES HUMAINS : UNE ANALYSE SUR QUATRE ANS Cet article présente au lecteur la politique et la pratique du gouvernement canadien en matière de traite des êtres humains depuis l'adoption, en 2000, du Protocole additionnel à la Convention des Nations unies contre la criminalité transnationale organisée visant à prévenir, réprimer et punir la traite des personnes, en particulier des femmes et des enfants. Après avoir présenté le Protocole dans son ensemble, l'article examine et analyse de façon critique l'action du Canada dans trois domaines essentiels du Protocole : la prévention de la traite, la protection des victimes et la punition des trafiquants. Depuis le début de notre recherche, le Canada a fait un pas en avant dans les mesures politiques adoptées. Le gouvernement a commencé par élaborer et mettre en oeuvre des mécanismes pour punir les trafiquants, donnant de ce fait suite à la plupart des recommandations du protocole des Nations unies en la matière. Par ailleurs, différents organes de l'État coordonnent leurs efforts pour mettre en place des projets de prévention, tant dans les pays d'origine que sur le territoire canadien, avec des campagnes de sensibilisation et d'éducation, et des collaborations en matière d'élaboration des politiques. Il reste néanmoins à trouver une solution adéquate aux aspects les plus structurels de la prévention. Enfin, sans s'éloigner du cadre fondamental du contrôle des frontières, les services gouvernementaux canadiens améliorent actuellement la protection des victimes de la traite interceptées lors d'opérations de police ou qui viennent demander de l'aide. Ces mesures de protection seraient davantage renforcées si les droits des migrants étaient explicitement inscrits dans la loi, ce qui n'est pas le cas en raison de la priorité accordée à la répression de la criminalité et à la sécurité. La protection formelle des victimes, telle que mise en oeuvre jusqu'à un certain point par des mesures appliquées en Europe et aux États-Unis, est présentée à titre de comparaison. Les conclusions de cet article exposent les défis auxquels restent confrontés les décideurs canadiens, à savoir moins insister sur la répression de la criminalité et la sécurité pour s'occuper davantage de la protection et de la promotion des droits fondamentaux des victimes de la traite. POLÍTICA CANADIENSE RELATIVA A LA TRATA DE PERSONAS: UN ANÁLISIS CUADRIENAL Este artículo presenta las políticas y prácticas del Gobierno canadiense en torno a la trata de personas desde la adopción, en 2000, del Protocolo de las Naciones Unidas relativo a la trata de personas. Tras hacer un repaso del Protocolo de las Naciones Unidas, este artículo examina y analiza críticamente los empeños del Canadá en tres esferas clave del Protocolo: prevención de la trata de personas, protección de las víctimas de la trata, y enjuiciamiento de los traficantes. Desde que se iniciara este estudio se han observado progresos en las respuestas políticas canadienses. El Gobierno comenzó desarrollando y llevando a la práctica sus instrumentos para la sanción y enjuiciamiento de los traficantes, respondiendo así a la mayoría de las recomendaciones de enjuiciamiento que contiene el Protocolo de las Naciones Unidas. Varias instituciones gubernamentales también coordinan sus esfuerzos con miras a la puesta en práctica de proyectos de prevención, tanto en los países de origen como en el Canadá, incluyendo campañas de concienciación, campañas educativas y colaboraciones con miras al desarrollo de políticas. Abstract This article explores dominant discourse on ,trafficking as modern slavery' in relation to the many legal and social fetters that have historically been and are today imposed upon individuals who are socially imagined as ,free'. It argues that discourse on ,trafficking as modern slavery' revitalizes the liberal understandings of freedom and restriction that have historically allowed vigorous moral condemnation of slavery to coexist with the continued imposition of extensive, forcible restrictions on individuals deemed to be ,free'. In place of efforts to build political alliances between different groups of migrants, as well as between migrants and non-migrants, who share a common interest in transforming existing social and political relations, ,trafficking as modern slavery' discourse inspires and legitimates efforts to divide a small number of ,deserving victims' from the masses that remain ,undeserving' of rights and freedoms. Biopolitical Management, Economic Calculation and "Trafficked Women"

Narratives surrounding human trafficking, especially trafficking in women for sex work, employ gendered and racialized tropes that have among their effects, a shrouding of women's economic decision-making and state collusion in benefiting from their labour. This paper explores the operation of these narratives in order to understand the ways in which they mask the economics of trafficking by sensationalizing the sexual and criminal aspects of it, which in turn allows the state to pursue political projects under the guise of a benevolent concern for trafficked women and/or protection of its own citizens. This paper will explore one national example: Article 18 of Italian Law 40 (1998). I argue that its passage has led to an increase in cooperation with criminal prosecution of traffickers largely because it approaches trafficked women as capable of making decisions about how and what they themselves want to do. This paper will also consider a more global approach to trafficking embedded in the concept of "migration management", an International Organization for Migration (IOM) framework that is now shaping EU, US and other national immigration laws and policies that impact trafficking. It will also examine the inherent limitations of both the national and global approach as an occasion to unpack how Article 18 and Migration Management function as forms of biopolitical management that participate in the production of "trafficking victims" into a massified population to be managed, rather than engender a more engaged discussion of what constitutes trafficking and how to redress it. How do Smuggling and Trafficking Operate via Irregular Border Crossings in the Middle East?

This article summarizes main trends, issues, actors, and activities regarding the operation and extension of human trafficking and smuggling via irregular border crossings in the Middle East. Its premise is that rather than the obvious involvement of hierarchical mafia-type organized crime groups, globally articulated networks of locally operating independent, individual groups comprise the essential foundation for human trafficking and smuggling in the region. The available empirical evidence first suggests that elaborating on various aspects of human trafficking and smuggling is a delicate task and any consideration of priorities for data collection and analysis on these activities must start with a clear idea of the information needed and how to obtain that information. Given the highly sensitive nature of trafficking and smuggling issues, there is no simple research practice that can satisfy all these concerns. It is within this context that our analysis here only offers some partial explanation of the complex nature of human trafficking and smuggling in the Middle East. The data used here provide, to the best of our knowledge, the first primary, reliable, and representative information on traffickers and smugglers as they come directly from the narratives of the traffickers and smugglers interviewed. Dimensions and dynamics of irregular migration

Abstract This contribution critically reviews existing data and other recent sources to provide an overview of the dimensions and dynamics of contemporary irregular migration. First it considers the utility and uses of irregular migrant statistics, considering their inherent inaccuracy, their inability to distinguish different types of irregular migrant, the way that data is collected, and the purposes to which it is put. The second section reviews the conceptual and practical challenges associated with counting irregular migrants. Conceptual challenges include: differentiating stocks from flows, addressing the variety of routes into irregularity, distinguishing migrant smuggling from human trafficking, separating asylum from aggregate statistics, and acknowledging that migrants' legal status can change quickly. Practical challenges associated with a series of direct and indirect methods for collecting statistics (including national censuses) are reviewed, and the difficulty for researchers to access official statistics highlighted. The third section presents estimates of the scale and scope of irregular migration, and data from regularisation programmes in various high-income countries. The fourth section reviews explanations for irregular migration, distinguishing macro-level explanations that focus on structural causes from meso-level explanations concerned with the role of policies and intermediaries, and also notes the shortage of micro-level explanations concerned with individual and family decision-making. The final section considers the consequences of irregular migration, with a particular focus on security. The review suggests that while irregular migration can undermine state sovereignty, the implications of irregular migration for the ,human security' of those involved should not be underestimated. Modern-Day Child Slavery1

Child slavery is a contemporary global problem existing since ancient times. The concept of slavery and practices similar to it are defined in a range of international instruments. Children are particularly vulnerable to slavery-like practices, and their special plight is addressed by the UN Convention on the Rights of the Child (CRC,in particular Art 32 on the right to be protected from economic exploitation) and the ILO Worst Forms of Child Labour Convention, 1999 (No. 182). Furthermore, the Palermo Protocol on human trafficking (of 2000) provides important tools to help shape legislative policy against another form of slavery, namely the trafficking of adults and children.
