BUSINESS METHOD PATENTS AND U.S. FINANCIAL SERVICES

A decade after the State Street decision, more than 1,000 business method patents are granted each year. Yet, only 1 in 10 is obtained by a financial institution. Most business method patents are also software patents. Have these patents increased innovation in financial services? To address this question, we construct new indicators of research and development intensity based on the occupational composition of financial industries. The financial sector appears more research intensive than official statistics would suggest but less than the private economy taken as a whole. There is considerable variation across industries but little apparent trend. There does not appear to be an obvious effect from business method patents on the sector's research intensity. Looking ahead, three factors suggest that the patent system may affect financial services as it has electronics: (1) the sector's heavy reliance on information technology, (2) the importance of standard setting, and (3) the strong network effects exhibited in many areas of finance. Even today litigation is not uncommon; we sketch a number of significant examples affecting financial exchanges and consumer payments. The legal environment is changing quickly. We review a number of important federal court decisions that will affect how business method patents are obtained and enforced. Review of carrot fly control in Northern Europe , 2009,

In February 2009, the European and Mediterranean Plant Protection Organization (EPPO) held a workshop to discuss the management of carrot fly (Psila rosae) within Europe. Prior to the workshop, participants completed a questionnaire about carrot fly and current control methods and some of the information is summarised in this paper. In general, this pest is controlled adequately at present, but there is a heavy reliance on insecticides. The responses to the questionnaire highlighted a number of issues, in particular: the limited range and efficacy of the insecticides available at present, concerns about the availability of effective control measures in the future and a need for improvements in the targeting of treatments through forecasting and monitoring and the use of treatment thresholds. RECONSTRUCTING PLUMAGE EVOLUTION IN ORIOLES (ICTERUS): REPEATED CONVERGENCE AND REVERSAL IN PATTERNS

Abstract. Several empirical studies suggest that sexually selected characters, including bird plumage, may evolve rapidly and show high levels of convergence and other forms of homoplasy. However, the processes that might generate such convergence have not been explored theoretically. Furthermore, no studies have rigorously addressed this issue using a robust phylogeny and a large number of signal characters. We scored the appearance of 44 adult male plumage characters that varied across New World orioles (Icterus). We mapped the plumage characters onto a molecular phylogeny based on two mitochondrial genes. Reconstructing the evolution of these characters revealed evidence of convergence or reversal in 42 of the 44 plumage characters. No plumage character states are restricted to any groups of species higher than superspecies in the oriole phylogeny. The high frequency of convergence and reversal is reflected in the low overall retention index (RI = 0.66) and the low overall consistency index (CI = 0.28). We found similar results when we mapped plumage changes onto a total evidence tree. Our findings reveal that plumage patterns and colors are highly labile between species of orioles, but highly conserved within the oriole genus. Furthermore, there are at least two overall plumage types that have convergently evolved repeatedly in the three oriole clades. This overall convergence leads to significant conflict between the molecular and plumage data. It is not clear what evolutionary processes lead to this homoplasy in individual characters or convergence in overall pattern. However, evolutionary constraints such as developmental limitations and genetic correlations between characters are likely to play a role. Our results are consistent with the belief that avian plumage and other sexually selected characters may evolve rapidly and may exhibit high homoplasy. The overall convergence in oriole plumage patterns is an interesting evolutionary phenomenon, but it cautions against heavy reliance on plumage characters for constructing phylogenies. [source]


Pricing Pension Insurance: The Proposed Levy Structure for the Pension Protection Fund,

The UK Pension Protection Fund (PPF), established by the 2004 Pensions Act to protect beneficiaries of defined benefit pension schemes when the sponsor becomes insolvent and the scheme is underfunded, is required to finance itself through a levy on participating schemes. In July 2005, the PPF issued a consultative document setting out its proposal for the structure of the levy. In this paper, we provide a critique of the proposal and, in particular, its heavy reliance on securing levy income from the weakest schemes. We propose an alternative structure for the levy that recognises the limits on capacity to pay and also mitigates some other undesirable features of the proposal. [source]


USING UPLAND FOREST IN SHIMENTAI NATURE RESERVE, CHINA,

ABSTRACT. The Shimentai Nature Reserve in Yingde County, Guangdong Province, China, established recently in a subtropical upland forest area, has served for ages as an essential and customary source of livelihood for local people. Assessment of forest usage indicates heavy reliance by villagers on its diversified biotic resources. This forest dependence, associated with socioeconomic factors such as distance from village, ethnic origin, out-migration of rural youngsters, and a local tradition of conservation, is unlikely to decline in the near future. The reserve management recognizes the need to address the livelihood issues of local people and to win local support. A pragmatic adherence to provincial and higher-level policies that exclude forest-tapping activities could lead to more people-versus-park conflicts, which would dilute fundamental conservation objectives. A more enlightened and localized approach that nurtures a synergy between limited forest use and conservation while helping to develop new income sources could furnish workable alternatives. Recognition of Indigenous Interests in Australian Water Resource Management, with Particular Reference to Environmental Flow Assessment

Australia's new national water policy represents a substantial change from the previous approach, because it recognises a potential need for allocations to meet particular indigenous requirements, which will have to be quantitatively defined in water allocation plans. However, indigenous values associated with rivers and water are presently poorly understood by decision-makers, and some are difficult to quantify or otherwise articulate in allocation decisions. This article describes the range of Australian indigenous values associated with water, and the way they have been defined in contemporary water resource policy and discourse. It argues that the heavy reliance of indigenous values on healthy river systems indicates that, theoretically at least, they are logically suited for consideration in environmental flow assessments. However, where indigenous interests have been considered for assessment planning purposes indigenous values have tended to be overlooked in a scientific process that leaves little room for different world views relating to nature, intangible environmental qualities and human relationships with river systems that are not readily amenable to quantification. There is often an implicit but untested assumption that indigenous interests will be protected through the provision of environmental flows to meet aquatic ecosystem requirements, but the South African and New Zealand approaches to environmental flow assessment, for example, demonstrate different riverine uses potentially can be accommodated. Debate with indigenous land-holders and experimentation will show how suited different environment flow assessment techniques are to addressing indigenous environmental philosophies and values. Modification of cardiovascular risk in hemodialysis patients: An evidence-based review

Abstract Cardiovascular disease accounts for 40% to 50% of deaths in dialysis populations. Overall, the risk of cardiac mortality is 10-fold to 20-fold greater in dialysis patients than in age and sex-matched controls without chronic kidney disease. The aim of this paper is to review critically the evidence that cardiac outcomes in dialysis patients are modified by cardiovascular risk factor interventions. There is limited, but as yet inconclusive controlled trial evidence that cardiovascular outcomes in dialysis populations may be improved by antioxidants (vitamin E or acetylcysteine), ensuring that hemoglobin levels do not exceed 120 g/L (especially in the setting of known cardiovascular disease), prescribing carvedilol in the setting of dilated cardiomyopathy, and by using cinacalcet in uncontrolled secondary hyperparathyroidism. Similarly, there are a number of negative controlled trials, which have demonstrated that statins, high-dose folic acid, angiotensin-converting enzyme inhibitors, multiple risk factor intervention via multidisciplinary clinics, and high-dose or high-flux dialysis are ineffective in preventing cardiovascular disease. Although none of these studies could be considered conclusive, the negative trials to date should raise significant concerns about the heavy reliance of current clinical practice guidelines on extrapolation of findings from cardiovascular intervention trials in the general population. It may be that cardiovascular disease in dialysis populations is less amenable to intervention, either because of the advanced stage of chronic kidney disease or because the pathogenesis of cardiovascular disease in dialysis patients is different from that in the general population. Large, well-conducted, multicenter randomized-controlled trials in this area are urgently required. [source]


Mercury accumulation in the fish community of a sub-Arctic lake in relation to trophic position and carbon sources

Summary 1Stable isotope analysis has improved understanding of trophic relationships among biota. Coupled with contaminant analysis, stable isotope analysis has also been used for tracing the pattern and extent of biomagnification of contaminants in aquatic food webs. 2Combined analysis of nitrogen (, 15 N) and carbon (, 13 C) isotopes from fish species in a sub-Arctic lake were related to tissue mercury (Hg) concentrations to assess whether carbon sources influenced Hg accumulation in fish, in addition to trophic position. 3Statistical models were used to estimate Hg biomagnification and uptake, to elucidate Hg accumulation dynamics and to appraise the relative importance of Hg exposure routes for the fish species. 4Species Hg contamination increased as a function of trophic position (, 15 N) and was inversely related to the , 13 C signature. Species connected to the benthic food chain had lower Hg concentrations than species connected to the pelagic food chain. Species undergoing ontogenetic dietary shifts with increasing size, e.g. lake trout Salvelinus namaycush , also showed increased Hg concentrations with increasing reliance on pelagic fish as prey. 5The results indicate that both vertical (trophic) and horizontal (habitat) food web structure influence Hg concentrations in fish tissue. 6The biomagnification and uptake models indicated that contamination at the base of the food chain in the lake exceeded estimates for more southerly environments, thereby demonstrating the importance of dietary and water column Hg exposure routes in the sub-Arctic for determining Hg concentrations in fish. 7Overall, the data reported here demonstrate how a combination of ecological concepts (food webs), developing ecological methods (stable isotopes) and environmental geochemistry can combine profitably to indicate the risks of exposure to environmental contaminants. Additional studies of the dynamics of Hg accumulation in the food webs of sub-Arctic lakes are needed, particularly in the light of the estimated high biomagnification rates and the heavy reliance of Inuit communities on subsistence fish harvests. The comparison between ad valorem and specific taxation is among the oldest issues in formal public finance and is important for policy in the European Union (EU) and elsewhere. This paper develops and articulates simple but very general elasticity rules that characterize the optimal balance between the two in a model of endogenous product quality. These rules temper the preference for ad valorem taxation that emerges from homogeneous product models, pointing to relatively heavy reliance on whichever form of taxation has the least effect on product quality. Flowers Are an important food for small apes in southern Sumatra

Abstract Flowers are included in the diets of many primates, but are not generally regarded as making an important contribution to primate energy budgets. However, observations of a number of lemur, platyrrhine, and cercopithecine populations suggest that some flower species may function as key primate fallback foods in periods of low abundance of preferred foods (generally ripe fruits), and that flowers may be preferred foods in some cases. I report heavy reliance on flowers during some study months for a siamang (Symphalangus syndactylus) population in southern Sumatra. Siamangs at Way Canguk spent 12% of feeding time eating flowers from October 2000 to August 2002, and in 1 month flower-feeding time exceeded 40% of total feeding time. The overall availabilities of fig and nonfig fruits, flowers, and new leaves in the study area were not significant predictors of the proportion of time that siamangs spent consuming any plant part. However, flower-feeding time was highest in months when nonfig fruit-feeding time was lowest, and a switch from heavy reliance on fruit to substantial flower consumption was associated with a shift in activity patterns toward reduced energy expenditure, which is consistent with the interpretation that flowers may function as a fallback food for Way Canguk siamangs. Hydnocarpus gracilis, a plant from which siamangs only consume flowers, was the third-most-commonly consumed plant at Way Canguk (after Ficus spp. and Dracontomelon dao), and flowers from this plant were available in most months. It is possible that relatively high local availability of these important siamang plant foods is one factor promoting high siamang density in the study area. Am. J. Seven Challenges in International Development Assistance for Health and Ways Forward

This paper outlines seven challenges in development assistance for health, which in the current financial context, have become even more important to address. These include the following: (1) the proliferation of initiatives, focusing on specific diseases or issues, as well as (2) the lack of attention given to reforming the existing focal health institutions, the WHO and World Bank. (3) The lack of accountability of donors and their influence on priority-setting are part of the reason that there is "initiavitis," and resistance to creating a strong UN system. (4) Other than absolute quantity of aid, three other challenges linked to donors relate to the quality of aid financing particularly the pragmatic difficulties of financing horizontal interventions, (5) the marginal involvement of developing country governments as aid recipients, and (6) the heavy reliance on Northern-based organizations as managers of funds. (7) The final challenge discussed focuses on two unintended consequences of the recent linking of health and foreign policy for international development assistance. The paper then provides three suggestions for ways forward: creating new mechanisms to hold donors to account, developing national plans and strengthening national leadership in health, and South-South collaboration. Fractional factorial designs for legal psychology

Researchers considering novel or exploratory psycholegal research are often able to easily generate a sizable list of independent variables (IVs) that might influence a measure of interest. Where the research question is novel and the literature is not developed, however, choosing from among a long list of potential variables those worthy of empirical investigation often presents a formidable task. Many researchers may feel compelled by legal psychology's heavy reliance on full-factorial designs to narrow the IVs under investigation to two or three in order to avoid an expensive and unwieldy design involving numerous high-order interactions. This article suggests that fractional factorial designs provide a reasonable alternative to full-factorial designs in such circumstances because they allow the psycholegal researcher to examine the main effects of a large number of factors while disregarding high-order interactions. When Noble Aspirations Fail: Why We Need the Approximation Rule

ABSTRACT,Critics of the American Law Institute's proposed "approximation rule" often imply that its adoption would eliminate many current family court practices, such as mandatory mediation or parent education. This comment notes that, in fact, there is no connection between the approximation rule and these services. Understanding the approximation rule, and the need for it, requires us to look in an entirely different direction,namely, at the way in which the current "best interests of the child" standard makes custody courts deeply dependent on professional custody evaluators. This dependence is especially troubling because the scientific basis for custody evaluations is hotly contested, with noted psychologists describing it as weak or lacking. The approximation rule is an alternative to current law's heavy reliance on flawed science. [source]


Early childhood services: evolution or revolution?

This paper considers what progress has been made towards the development of a coherent national policy on services for young children under eight and their families. Since the election of a ,new' Labour government in 1997, services for children and families have been higher on the public agenda than at any time in living memory. Much has been achieved, through additional funding, expansion of services, and a more coordinated approach to service provision. But there is still a severe shortage of day care places for children under three, too few appropriately trained staff, a heavy reliance on short term funding, and no agreement on the overall policy on and purpose of early childhood services.
