Services of General Interest in EC Law: Matching Values to Regulatory Technique in the Public and Privatised Sectors

All the European Union Member States have long traditions of state activity in providing key services (such as the utilities, health and education) to their citizens and underpinning both such direct provision and provision of services by non-state actors with certain administrative or legal guarantees. In European Community doctrines they are referred to as ,services of general interest' within which is a narrower class of ,services of general economic interest'. The diverse national public service traditions have been challenged both by the requirements of the single market and by other pressures such as fiscal crisis and broader public sector reform. This article examines the means by which services to which special principles should be applied can be identified and focuses on the range of sometimes contradictory values denoted by the term ,services of general interest', examining the range of regime types (based on hierarchical, competition-based and community forms) by which those values might be pursued. The concluding section suggests that the matching of values to techniques should not be made according to the importance of the values to be pursued, but rather by reference to which techniques are likely to be effective given the configuration of interests and capacities and existing culture within the target domain. On slow protein crystal nucleation: cluster-cluster aggregation on diffusional encounters

Abstract With a view to experimental results on protein crystal nucleation the effects of cluster coalescence are probed semi-quantitatively. The steric association restriction, which stems from the patchy surface of the protein molecules, explains both experimentally measured low crystal nucleation rate and coalescence limitations for crystalline clusters of protein molecules. The conclusion is that due to its action, and the impact of rotational diffusion, the coalescence of critical (and/or supercritical) clusters should be rejected as a conceivable alternative for explaining the slow nucleation of protein crystals. Besides, the analysis of cluster-cluster aggregation on diffusional encounters may be of more general interest; it may be helpful by considering the coalescence of structured bio-nano-particles. Gene therapy and enhancement for diabetes (and other diseases): the multiplicity of considerations

Abstract Gene therapy has reached the forefront of studies and research over the last 30 years because of its potential for curing, treating, and preventing diseases associated with DNA mutations. Type 1 and type 2 diabetes are two examples of very common polygenic and multifactorial diseases. The huge amount of scientific literature on this topic reflects a growing general interest in the possibilities of altering our genetic heritage and thus controlling the onset of diseases associated with mutations and relative risk factors. We have focussed on the new treatment opportunities and possibility of enhancing an individual's health, physical well-being, and even an individual's behaviour through technologies specially designed for therapeutic purposes, which have been presented in literature. This historical perspective shows how this type of research, however, was immediately subjected to an ethical evaluation, especially regarding the decoding of the human genome and the questions raised by the alteration of our genetic heritage through new biotechnologies. Moreover, understanding the limitations of gene therapy protocol experiments and the multifactorial nature of many diseases, which have a genetic base, also contributes to these considerations. Ground Water Sustainability: Methodology and Application to the North China Plain

This article analyzes part of a ground water flow system in the North China Plain (NCP) subject to severe overexploitation and rapid depletion. A transient ground water flow model was constructed and calibrated to quantify the changes in the flow system since the predevelopment 1950s. The flow model was then used in conjunction with an optimization code to determine optimal pumping schemes that improve ground water management practices. Finally, two management scenarios, namely, urbanization and the South-to-North Water Transfer Project, were evaluated for their potential impacts on the ground water resources in the study area. Although this study focuses on the NCP, it illustrates a general modeling framework for analyzing the sustainability, or the lack thereof, of ground water flow systems driven by similar hydrogeologic and economic conditions. The numerical simulation is capable of quantifying the various components of the overall flow budget and evaluating the impacts of different management scenarios. The optimization modeling allows the determination of the maximum "sustainable pumping" that satisfies a series of prescribed constraints. It can also be used to minimize the economic costs associated with ground water development and management. Furthermore, since the NCP is one of the most water scarce and economically active regions in the world, the conclusions and insights from this study are of general interest and international significance. On Pornography: MacKinnon, Speech Acts, and "False" Construction

Although others have focused on Catharine MacKinnon's claim that pornography subordinates and silences women, I here focus on her claim that pornography constructs women's nature and that this construction is, in some sense, false. Since it is unclear how pornography, as speech, can construct facts and how constructed facts can nevertheless be false, MacKinnon's claim requires elucidation. Appealing to speech act theory, I introduce an analysis of the erroneous verdictive and use it to make sense of MacKinnon's constructionist claims. The "right distance" when dealing with violence

The issue of the researcher's relationship with the subject of ,extreme violence' is approached here from the point of view not of subjective motivations, but of the scientific rule of distanc-ing which, in the absence of specific epistemo-logical recommendations, seems to apply in this case as in others. At times of ,exit' from violence, when a repressive authoritarian regime is replaced by a democratic government, the ,right Distance' of the researcher has particular consequences: it may coincide with the tenets of governmental ,reconciliation' policies, in particular the injunction to victims to weigh their demands against the need for pacification in the general interest. This convergence - which does not necessarily involve collusion - shows how difficult it is to find the right stance towards the subject of ,violence': epistemological rules cannot be dissociated from a particular political context and from a social relationship with violence, and may thus have normative implications. Remarkable key features of general interest are (i) easy isolation of the products from catalyst by simple diethyl ether/water-surfactant two phase separation, (ii) catalyst loading as low as 1% mol, (iii) good yields, sulfoxide 3 to sulfone 4 ratio up to 200,:,1 and enantioselectivities up to 88%, (iv) mild experimental conditions. ,A Benevolent Institution for the Suppression of Evil': Joseph Conrad's The Secret Agent and the Limits of Policing

The study of law in literature stimulates critical reflection about law and the limits of its institutions by expanding contextual analysis to include the emotive discourses of fiction. This article starts from the premisses that the orthodox separation of literary expression from social scientific writing is not immutable and that different temporal settings are not barriers to exploring themes that traverse them. It uses Joseph Conrad's The Secret Agent, a story of policing and anarchism in late nineteenth-century London, in order to discuss the limits of policing today. This novel is read in parallel with two modern police studies to show how it prefigures current concerns, portraying policing as an imperfect totem of security, immaterial to the individual's emotional crises, which, by extension, can be seen to illustrate the limits of law itself. This article thus raises methodological and theoretical issues of general interest to the study of law in society and suggests how reading literature can thicken' legal analysis by offering experience of the emotional beyond that law ignores. In Situ X-Ray Radiography and Tomography Observations of the Solidification of Aqueous Alumina Particle Suspensions,Part I: Initial Instants

This paper investigates by in situ high-resolution X-ray radiography and tomography the behavior of colloidal suspensions of alumina partic les during directional solidification by freezing. The combination of these techniques provided both qualitative and quantitative information about the propagation kinetic of the solid/liquid interface, the particle redistribution between the crystals and a particle-enriched phase, and the three-dimensional organization of the ice crystals. In this first part of two companion papers, the precursor phenomena leading to directional crystallization during the first instants of solidification are studied. Mullins,Sekerka instabilities are not necessary to explain the dynamic evolution of the interface pattern. Particle redistribution during these first instants is dependent on the type of crystals growing into the suspension. The insights gained into the mechanisms of solidification of colloidal suspensions may be valuable for the materials processing routes derived for this type of directional solidification (freeze-casting), and of general interest for those interested in the interactions between solidification fronts and inert particles. Superstar Effects in Deluxe Gastronomy , An Empirical Analysis of Value Creation in German Quality Restaurants

Summary We analyze whether superstar effects (disproportionate income effects) exist in the deep-pocket market for quality gastronomy in Germany, and what factors determine the stars' rents. In quality gastronomy, the stars can be the restaurant chefs. Building on Rosen's (1981) and Adler's (1985) central theories on star effects, we explore two potential sources of stardom. Following Rosen (1981), we test if quality differences between the chefs' performances have a direct effect on financial rewards ("direct superstar effect"). Following Adler (1985), we assess the income effect of a media presence of chefs ("classical Superstar effect"). Through this, we deal with an economic issue of general interest: does it pay more to develop your skills in your core business to perfection, or to maintain the current level of skills and invest in self-marketing? Analyzing a sample of 288 restaurants, for potential star effects by differences in quality, we find that higher quality increases chefs' revenues. Yet, revenues do not increase disproportionately, and achieving higher quality requires substantial investments in exquisite ingredients, excellent staff and prime ambience. This problem, also called the "agony of the stars", has manifested itself in the bankruptcies of European three-star restaurants in recent years. As regards potential star effects by differences in media presence, we observe a positive impact of TV appearances on financial rewards. Yet, these income effects are moderate as well, so there is neither a direct, nor a classical superstar effect in quality gastronomy. We argue that although both perfection of skills and self-marketing have similarly positive income effects, self-marketing seems both the less risky and the less stressful way to enhance income. Ethics in Neuroscience Graduate Training Programs: Views and Models from Canada

Consideration of the ethical, social, and policy implications of research has become increasingly important to scientists and scholars whose work focuses on brain and mind, but limited empirical data exist on the education in ethics available to them. We examined the current landscape of ethics training in neuroscience programs, beginning with the Canadian context specifically, to elucidate the perceived needs of mentors and trainees and offer recommendations for resource development to meet those needs. We surveyed neuroscientists at all training levels and interviewed directors of neuroscience programs and training grants. A total of 88% of survey respondents reported general interest in ethics, and 96% indicated a desire for more ethics content as it applies to brain research and clinical translation. Expert interviews revealed formal ethics education in over half of programs and in 90% of grants-based programs. Lack of time, resources, and expertise, however, are major barriers to expanding ethics content in neuroscience education. We conclude with an initial set of recommendations to address these barriers which includes the development of flexible, tailored ethics education tools, increased financial support for ethics training, and strategies for fostering collaboration between ethics experts, neuroscience program directors, and funding agencies. Listeriolysin O as cytotoxic component of an immunotoxin

Abstract Monoclonal antibodies (mAbs) have been developed over the past years as promising anticancer therapeutics. The conjugation of tumor specific mAbs with cytotoxic molecules has been shown to improve their efficacy dramatically. These bifunctional immunotoxins, consisting of covalently linked antibodies and protein toxins, possess considerable potential in cancer therapy. Many of them are under investigation in clinical trials. As a result of general interest in new toxic components, we describe here the suitability of the bacterial protein Listeriolysin O (LLO) as cytotoxic component of an immunotoxin. Unique characteristics of LLO, such as its acidic pH optimum and the possibility to regulate the cytolytic activity by cysteine-oxidation, make LLO an interesting toxophore. Oxidized LLO shows a substantially decreased cytolytic activity when compared with the reduced protein as analyzed by hemolysis. Both oxidized and reduced LLO exhibit a cell-type-unspecific toxicity in cell culture with a significantly higher toxicity of reduced LLO. For cell-type-specific targeting of LLO to tumor cells, LLO was coupled to the dsFv fragment of the monoclonal antibody B3, which recognizes the tumor-antigen Lewis Y. The coupling of LLO to dsFv-B3 was performed via cysteine-containing polyionic fusion peptides that act as a specific heterodimerization motif. The novel immunotoxin B3-LLO could be shown to specifically eliminate antigen positive MCF7 cells with an EC50 value of 2.3 nM, whereas antigen negative cell lines were 80- to 250-fold less sensitive towards B3-LLO. Reduction of the amyloidogenicity of a protein by specific binding of ligands to the native conformation

AcP, acylphosphatase; CD, circular dichroism; TFE, 2,2,2-trifluoroethanol; TTR, transthyretin Abstract It is known that human muscle acylphosphatase (AcP) is able, under appropriate conditions in vitro, to aggregate and form amyloid fibrils of the type associated with human diseases. A number of compounds were tested for their ability to bind specifically to the native conformation of AcP under conditions favoring denaturation and subsequent aggregation and fibril formation. Compounds displaying different binding affinities for AcP were selected and their ability to inhibit protein fibrillization in vitro was evaluated. We found that compounds displaying a relatively high affinity for AcP are able to significantly delay protein fibrillization, mimicking the effect of stabilizing mutations; in addition, the effectiveness of such outcome correlates positively to both ligand concentration and affinity to the native state of AcP. By contrast, the inhibitory effect of ligands on AcP aggregation disappears in a mutant protein in which such binding affinity is lost. These results indicate that the stabilization of the native conformation of amyloidogenic proteins by specific ligand binding can be a strategy of general interest to inhibit amyloid formation in vivo.
