State Collapse and Fresh Starts: Some Critical Reflections

In examining the incidence of state collapse, two central themes emerge, one concerned with the search for causalities and the other concerned with appropriate responses. There is often a misplaced tendency to look for single causes and explanations of state collapse, and similarly to propose single, preferably ,quick,fix' solutions. Instead, what seems to be called for is a more nuanced scrutiny which differentiates the factors leading to collapse in specific instances, and a reconsideration, in the light of this scrutiny, of responses and possible external actor involvement. This article addresses these two themes. Firstly, it takes a preliminary look into the complex web of conditioning and facilitating factors that may or may not set in motion a chain reaction eventually leading to state collapse, examining the extent to which any emerging patterns can be identified. Secondly, it looks more closely at the response side to incidences of state collapse, specifically external responses. Whilst external actors, notably the ,donor community', are trying to better prepare themselves for the eventualities of crises of governance and state collapse in various countries, and to design more effective strategies and instruments, it remains to be seen to what extent there is a ,fit' between the determinants and dynamics of state collapse and the responses and solutions for restoration which are offered. The concept of a "fresh start" for individual debtors has been introduced in the Netherlands in 1998. Until then a natural person could be pursued for the debts he could not pay indefinitely. Their position was not different from the unfortunate debtors in many European countries to day. The entrance to the "fresh start- procedure" in the Netherlands is surrounded by impediments, the access is linked to the debtor in good faith, but after three years the fresh start comprises all debts (except student loans), none excluded. In the United States the fresh start doctrine is long established law, the entrance is easy, but many debts may be excluded. Because of public dissatisfaction in both countries the concept has changed. In the Netherlands many debts may now be excluded from the fresh start and in the United States a means test has been introduced. Individual voluntary arrangements: A ,fresh start' for salaried consumer debtors in England and Wales,

Since the mid-1990s the number of consumer insolvencies in England and Wales has grown exponentially. The UK's Insolvency Act 1986 offers two formal responses to personal insolvency: bankruptcy and individual voluntary arrangements (,IVAs'). While consumers have used both these debt relief mechanisms in increasing numbers in recent years, IVAs,regulated agreements between debtors and creditors facilitated by a licensed insolvency practitioner, usually taking the form of a 5-year payment plan,grew faster than bankruptcies between 2003 and 2006. However, the level of new IVA approvals fell back in 2007 and the first half of 2008. This article charts the transformation of the IVA from a bankruptcy alternative originally designed for insolvent traders and professionals into a tool of consumer debt relief. It then seeks to explain both the stellar rise in IVA usage among consumer debtors and the subsequent stalling of IVA growth. The rise of consumer IVAs can be attributed largely to supply side changes in the market for debt resolution,in particular the emergence of volume providers commonly referred to as ,IVA factories',while a sustained backlash against the procedure and the providers instigated by institutional creditors demanding higher recoveries accounts for the subsequent decline in approvals. The article concludes by considering the near-term prospects for consumer IVAs within the context of the increasingly complex UK debt resolution market. Copyright © 2009 John Wiley & Sons, Ltd. BUREAUCRACIES REMEMBER, POST-BUREAUCRATIC ORGANIZATIONS FORGET?

The paper examines the hypothesis that post-bureaucratic forms of organization perform less well than traditional bureaucracies with respect both to organizational memory and learning from experience. First, the paper discusses the meanings of the main terms and concepts to be used in the argument, and delimits its domain. Second, it identifies a series of mechanisms that are likely to bring about memory loss. Third, it examines the empirical literature in search of evidence to confirm or disconfirm the existence and effects of these mechanisms. Fourth, it reflects on its own limitations. Finally, it sets out some broad conclusions concerning the state of organizational memories in the public sector. The aim is to develop new theory, identify relevant generative mechanisms, set this model alongside such evidence as is available, and suggest lines for further research. The new men of the Empire are the ones who believe in fresh starts, new chapters, clean pages; I struggle on with the old story, hoping that, before it is finished, it will reveal to me why it was that I thought it worth the trouble.
