A European Legal Method?

On European Private Law, Scientific Method
This article examines the relationship between European private law and scientific method. It argues that a European legal method is a good idea. Not primarily because it will make European private law scholarship look more scientific, but because a debate on the method of a normative science necessarily has to be a debate on its normative assumptions. In other words, a debate on a European legal method will have much in common with the much desired debate on social justice in European law. Moreover, it submits that, at least after the adoption of the Common Frame of Reference by the European institutions, European contract law can be regarded as a developing multi-level system that can be studied from the inside. Finally, it concludes that the Europeanisation of private law is gradually blurring the dividing line between the internal and external perspectives, with their respective appropriate methods, in two mutually reinforcing ways. First, in the developing multi-level system it is unclear where the external borders of the system lie, in particular the borders between Community law and national law. Second, because of the less formal legal culture the (formerly) external perspectives, such as the economic perspective, have easier access and play an increasing role as policy considerations. Epsilon-Like Electrocardiographic Pattern in a Patient with Brugada Syndrome

Both Brugada syndrome (BrS) and arrhythmogenic right ventricle dysplasia/cardiomyopathy (ARVD/C) can cause repolarization abnormalities in right precordial leads and predispose to sudden cardiac death (SCD) due to ventricular arrhythmias. Although there is controversy over whether BrS is distinct from ARVD/C, it is believed that both are different clinical entities with respect to both the clinical presentation and the genetic predisposition. The coexistence of these two relatively rare clinical entities is also reported, but, some hypothesized that it is more possible that disease of the right ventricular muscle might accentuate the Brugada electrocardiographic pattern. In clinic practice, there may be cases where the dividing line is not so clear. We report a 33-year-old male presenting with recurrent syncope, who has a peculiar pattern of coved-type ST-segment elevation (ST-SE) with epsilon-like wave in right precordial leads. [source]


Into adulthood: a follow-up study of 718 young people who were placed in out-of-home care during their teens

ABSTRACT In this study, national register data were used to analyse long-term outcomes at age 25 for around 700 Swedish young people placed in out-of-home care during their teens. The sample consisted of 70% of all 13- to 16-year olds who entered out-of-home care in 1991. Results revealed a dividing line between young people placed in care for behavioural problems and those placed for other reasons. Young woman and men from the first group had , in comparison with peers who did not enter care , very high rates of premature death, serious involvement in crime, hospitalizations for mental-health problems, teenage parenthood, self-support problems and low educational attainment. Young people who were placed for other reasons had better outcomes, but still considerably worse than non-care peers. Young women tended to do better than young men, regardless of reasons for placement. Very high rates of hospitalizations for mental health problems were found among young people placed for behavioural problems. Breakdown of placement was found to be a robust indicator of poor long-term prognosis. [source]


Inventing paganism in eighth-century Bavaria

This article examines the hagiographies of Saints Emmeram and Corbinian and the synod of Neuching from eighth-century Bavaria. It argues that the references to pagan survivals in these texts are misleading, in the absence of other evidence of paganism in the region. Rather, since these texts were composed in a narrow window of time from 769,774, this anxiety reflects concerns aroused by pagan uprisings in neighbouring Carantania, which were only suppressed in 772. Thus, the texts' authors ,invented' paganism in their own culture as their perceptions of the dividing lines between Christianity and paganism grew sharper. [source]


Long-term trend analysis for precipitation in Asian Pacific FRIEND river basins

Abstract In order to analyse the long-term trend of precipitation in the Asian Pacific FRIEND region, records from 30 river basins to represent the large range of climatic and hydrological characteristics in the study area are selected. The long-term trend in precipitation time series and its association with the southern oscillation index (SOI) series are investigated. Application of the nonparametric Mann,Kendall test for 30 precipitation time series has shown that only four of these 30 time series have a long-term trend at the 5% level of significance. Nevertheless, most of the records tend to decrease over the last several decades. The dataset is further divided geographically into northern, middle, and southern zones, with 20°N and 20°S latitude as the dividing lines. The middle zone has the greatest variation and the southern zone the least variation over the past century. Also, the southern zone has greater variation during the past 30 years. The association between precipitation and SOI is investigated by dividing the precipitation records of each station into El Niño, La Niña, and neutral periods. The Wilcoxon rank-sum test showed that differences in precipitation for the three classes were most marked in the southern zone of the study area. The frequencies of below- and above-average precipitation for El Niño, La Niña, and neutral periods are estimated for the 30 precipitation time series as well. The results show that the frequencies of precipitation under each set of conditions, with lower precipitation generally associated with El Niño periods in the southern zone. Defiant desire in Namibia: Female sexual,gender transgression and the making of political being

ABSTRACT In this article, I explore local productions of desire in Namibia by focusing on the engagement of young, working-class lesbians with human rights ideologies of sexual freedom. I discuss how various techniques deployed by a sexual minority-rights NGO allow youth to amplify and legitimize their embodied sense of sexual,gender difference. In my analysis of their self-mediated incitement, I regard desire as a moral practice; practices of self-determination and acts of resistance are generated and authenticated through repeated reflection on the internality of desire. My elaborations also emphasize class-related issues. I argue that struggles with class and gender inequality destabilize the very notion of "sexual identity" in ways that open up political and erotic possibilities between lesbians and other working-class women in Namibia, blurring the dividing lines of identity politics and of gender and class politics.
