Deontological Restrictions and the Self/Other Asymmetry

ABSTRACT This paper offers a partial justification of so-called "deontological restrictions." Specifically it defends the "self/other asymmetry," that we are morally obligated to treat our own agency, and thus its results, as specially important. The argument rests on a picture of moral obligation of a broadly Kantian sort. In particular, it rests on the basic normative assumption that our fundamental obligations are determined by the principles which a rational being as such would follow. These include principles which it is not essential for rational beings to accept, but acceptance of which we could non-arbitrarily attribute to them simply in their capacity as rational. A European Legal Method?

On European Private Law, Scientific Method
This article examines the relationship between European private law and scientific method. It argues that a European legal method is a good idea. Not primarily because it will make European private law scholarship look more scientific, but because a debate on the method of a normative science necessarily has to be a debate on its normative assumptions. In other words, a debate on a European legal method will have much in common with the much desired debate on social justice in European law. Moreover, it submits that, at least after the adoption of the Common Frame of Reference by the European institutions, European contract law can be regarded as a developing multi-level system that can be studied from the inside. Finally, it concludes that the Europeanisation of private law is gradually blurring the dividing line between the internal and external perspectives, with their respective appropriate methods, in two mutually reinforcing ways. First, in the developing multi-level system it is unclear where the external borders of the system lie, in particular the borders between Community law and national law. Second, because of the less formal legal culture the (formerly) external perspectives, such as the economic perspective, have easier access and play an increasing role as policy considerations. Moral Pluralism, Political Justification and Deliberative Democracy

We can make progress in political justification if we avoid debates about the extent of moral pluralism. Just by having a political view we are committed to its realization but also to its defence upon justifying grounds. It would be inconsistent to seek to realize my view in ways that undermined my ability to justify it. Yet justifying a view implies that I am open to challenges to it, and that perpetually draws me potentially into dialogue with all others, regardless of my will, and into structures which allow an inclusive dialogue to take place, with decisions being made, on the basis of open public discussion, with which I may disagree. Thus a form of deliberative democracy, probably with representative institutions, is justified, without any normative assumptions being made. [source]


Homophobia and Conservative Religion: Toward a More Nuanced Understanding

The failure of homophobia scales to consider the normative assumptions of religious communities may result in findings that are less useful in addressing this problem. In this study, 155 undergraduate students at a Christian university were surveyed, separately assessing attitudes toward celibate versus sexually active homosexual men and women. Results of multiple regression analyses found that participants who emphasized a person-behavior distinction (an accepted tenet of conservative religious ideology) held more negative attitudes toward lesbian women than those who were comparatively more accepting and did not emphasize such a distinction. However, participants who emphasized the person-behavior distinction held more positive attitudes toward gay men than those who were comparatively more rejecting and did not emphasize such a distinction. These relationships were significant even after accounting for variance attributable to general measures of religious commitment. Attempts to reduce homophobia within conservative religious communities may benefit from a more sensitive approach to their belief systems. [source]
