Selected AbstractsDefamation Cases against HistoriansHISTORY AND THEORY, Issue 3 2002Antoon De Baets Defamation is the act of damaging another's reputation. According to recent legal research, defamation laws may be improperly used in many ways. Some of these uses profoundly affect the historian's work: first, when defamation laws protect reputations of states or nations as such; second, when they prevent legitimate criticism of officials; and, third, when they protect the reputations of deceased persons. The present essay offers two tests of these three abuses in legal cases where historians were defendants. The first test, a short worldwide survey, confirms the occurrence of all three abuses; the second test (an empirical analysis of twenty,one cases (1965,2000) from nine western European countries) the occurrence of the third abuse. Both tests touch on problems central to the historical profession: living versus deceased persons; facts versus opinions; legal versus historical truth; the relationship between human dignity, reputation, and privacy; the role of politicians, veterans, and Holocaust deniers as complainants; the problem of amnestied crimes. The second test,the results of which are based on verdicts, commentaries, and press articles, and presented in a synoptic table,looks closely into the complainants' and defendants' profiles, the allegedly defamatory statements themselves, and the verdicts. All statements deemed defamatory were about such contemporary events as World War II (particularly war crimes, collaboration, and resistance) and colonial wars. Both tests amount to two conclusions. The first one is about historians' professional rights and obligations: historians should make true, but privacy,sensitive or potentially offending, statements only when the public interest is served; otherwise, they should have a right to silence. The second conclusion concerns defamation itself: defamation cases and threats to sue in defamation have a chilling effect on the historical debate; they are often but barely veiled attempts at censorship. [source] Perspectives on an Early Bronze Age Island Centre: An Analysis of Pottery from Daskaleio-Kavos (Keros) in the CycladesOXFORD JOURNAL OF ARCHAEOLOGY, Issue 4 2000Cyprian Broodbank Island central places occupy a prominent position in archaeological, anthropological and historical debate, but the number of early examples of such centres that have to date been investigated in detail remains small. One such central place in the Early Bronze Age (3rd millennium BC) Cycladic islands of the Aegean was the site of Daskaleio-Kavos on Keros, although the interpretation of this site's functions is controversial. Fieldwork at the site in 1987 generated a large sample of pottery that allows the site's local and inter-regional connections to be explored in detail for the first time. The results of ceramic analysis indicate that Daskaleio-Kavos operated as the active maritime centre of an intensive network of inter-island exchange. Dawes Author's Introduction The article was provoked by recent discussion of the so-called ,conflict thesis': the idea that the Christian faith and the findings of modern science are necessarily at odds. This thesis is generally attributed to John William Draper (1811,1882) and Andrew Dickson White (1832,1918). Recent opposition to their work dates from a 1979 publication by James Moore. Moore argues that the warfare metaphor employed by Draper and White misrepresents the historical reality, by suggesting that the religion and science debates were clashes between distinct groups of people who were sharply polarized and violently antagonistic. Since then, similar criticisms have been made by historians, such as David Livingstone, Ronald Numbers, and David Lindberg. A key question here is: what does the conflict thesis entail? If it holds that Christian thinkers have invariably opposed scientific progress, while the defenders of science have been non-believers, it would be demonstrably false. But there exist more interesting forms of conflict thesis, which are philosophical rather than historical. These suggest that there is some tension between what Christians have traditionally believed and the findings of modern science, particularly Darwin's theory of evolution by natural selection. Even if the two are not, strictly speaking, incompatible, the truth of one may constitute evidence against the truth of the other. Darwin's theory also undercuts traditional arguments from design, and highlights the epistemological divide between religious and scientific conceptions of authority. Most presenters follow Moore in opposing the conflict thesis, narrowly defined, but neglect the conflicts that my article highlights. 2. http://www.pbs.org/wgbh/nova/id/program.html Here one can view an excellent, 2-h PBS television documentary on the Dover, Pennsylvania trial in December 2005 regarding the teaching of ,intelligent design' (ID) in public schools. 3. http://www.butler.edu/clergyproject/rel_evol_sun.htm This is a letter signed by more than 11,000 clergy, arguing that there is no conflict between religion and science, and encouraging (among other things) the liturgical celebration of evolution by natural selection. 4. http://www.discovery.org/csc/ At the other end of the theological spectrum, this is the website of the Discovery Institute, devoted to opposing Darwinism and promoting ,intelligent design' (ID). Controversially, it presents ID as a scientific theory, rather than a religious doctrine. 5. http://www.asa3.org/ Somewhere between the Clergy Letter Project and the Discovery Institute lies the American Scientific Affiliation (ASA). The ASA ,does not take a position when there is honest disagreement between Christians', so it embraces a variety of perspectives. Sample Syllabus The following could form the basis for a graduate seminar on religion and science, focusing on the Darwinian controversies. One could, for instance, devote two classes to each of these topics. 1. The Draper-White Thesis I recommend reading extracts from the two writers thought to be responsible for the conflict thesis, to establish what each actually said. The Incompatibility Thesis Many authors attempt to show that Darwinism and Christianity and compatible. But it would be useful to examine Pope John Paul II's statement on this topic, along with some responses by biologists and philosophers. Ernan McMullin, ,Evolution and Special Creation', Zygon 28:3 (1993): 299,335. Focus Questions 1There exist many Christian thinkers who accept Darwin's theory of evolution by natural selection. Does that mean there is no conflict between Darwinism and Christianity? 2Taken at face value, Genesis 1,3 tells the story of the origins of the world and of human beings. What aspects of that story would you consider essential to the Christian faith? 3If we have an entirely natural explanation of the origins of complex living organisms, do we still have reasons to believe in a creator God? 4If God could have created complex living beings by a simple command, why would he choose a lengthy and wasteful process such as natural selection? 5Could a Christian regard the existence of God in the same way as a scientific hypothesis, that is to say, to be accepted only in so far as it is supported by the evidence? Seminar Activity I would suggest a debate, in which students sympathetic to the creationist position are asked to defend Darwin's theory, while students sympathetic to evolution are asked to argue against it. [source] LAND-USE DYNAMICS BEYOND THE AMERICAN URBAN FRINGE,GEOGRAPHICAL REVIEW, Issue 3 2001DAVID M. THEOBALD ABSTRACT. A deficiency common to both the historical debates over loss of agricultural land and the current discussions of urbanization and sprawl is a limited understanding of land-use dynamics beyond the urban fringe. Data aggregated at the county level poorly capture the fine-grained pattern of land-use change beyond the dynamic urban-rural interface. Furthermore, current urban-based definitions are poorly suited to delineate these areas, and low-density, exurban land use is difficult to measure using existing land-cover databases. Urbanization and the conversion of once-agricultural or other natural resource lands to other uses has traditionally been tracked using urban areas, as delimited in the U.S. census. Urban densities are typically defined as areas with more than 1,000 people per square mile, or 1.6 people per acre (U.S. Census Bureau 2000). Assuming an average of 2.5 people per housing unit, this translates to roughly 0.7 units per acre, or approximately 1 unit per 1.6 acres. The analytical units used in the census, however, both overbound and underbound areas with urban densities. About one-third of urban areas in 1990 comprised lower-than-urban housing density, thanks to overbounding. But, then, one-third of locations that had urban-level housing densities failed to be included in urban areas as a result of underbounding, which, if counted, would have constituted another 18 million acres of urban area. An increase over time of the average number of acres required per housing unit in exurban and higher-density locations occurred in roughly one-third of U.S. counties from 1960 to 1990 and persisted from 1990 to 2000. In 2000 roughly 38 million acres were settled at urban densities, and nearly ten times that much land was settled at rates from low, exurban density (as low as one house per 40 acres) to higher rates (up to one per 10 acres). This represents a continuing encroachment on land previously given over to other uses,habitat or agriculture. Practitioners of natural resource management need to recognize the ubiquity of exurban development and better incorporate the fine-scale patterns of land use beyond the urban fringe. [source] THE "INS" AND "OUTS" OF HISTORY: REVISION AS NON-PLACEHISTORY AND THEORY, Issue 4 2007MARNIE HUGHES-WARRINGTON ABSTRACT Revision in history is conventionally characterized as a linear sequence of changes over time. Drawing together the contributions of those engaged in historiographical debates that are often associated with the term "revision," however, we find our attention directed to the spaces rather than the sequences of history. Contributions to historical debates are characterized by the marked use of spatial imagery and spatialized language. These used to suggest both the demarcation of the "space of history" and the erasure of existing historiographies from that space. Bearing these features in mind, the essay argues that traditional, temporally oriented explanations for revision in history, such as Thomas S. Kuhn's Structure of Scientific Revolutions, miss the mark, and that a more promising line of explanation arises from the combined use of Michel Foucault's idea of "heterotopias" and Marc Augé's idea of "non-places." Revision in history is to be found where writers use imagery to move readers away from rival historiographies and to control their movement in the space of history toward their desired vision. Revision is thus associated more with control than with liberation. [source] Childhood, Agency and Youth JusticeCHILDREN & SOCIETY, Issue 4 2009Roger Smith This article seeks to reframe debates in the sphere of youth justice in order to move away from narrow and one-sided conceptualisations of young people who offend and appropriate forms of intervention with them. Whilst different positions have been adopted within the field of youth justice, largely around ,justice' or ,welfare' models of practice, the apparent polarisation of this conflict has obscured an underlying consensus, namely that the ,problem' is the child or young offender, and he/she needs either to be helped or coerced into becoming a conforming adult citizen. Largely absent from the field of youth justice have been other theoretical influences such as consideration of the nature of ,agency' and the construction of childhood. These alternative perspectives could offer us some insight into the limitations of historical debates in youth justice policy and practice, as will as pointing the way towards innovative and progressive alternative forms of practice. The strengths and shortcomings of contemporary developments, such as restorative interventions, will be discussed in this context, and the article will conclude that there is scope for developing positive, young person-centred models of youth justice practice if we base these on a proper understanding of childhood and children's agency.
