Securing the World and Challenging Civil Society: Before and After the ,War on Terror'

ABSTRACT Following President Bush's declaration of a ,War on Terror' in 2001, governments around the world introduced a range of counter-terrorist legislation, policies and practices. These measures have affected not only human rights and civil liberties but also civil society and aid frameworks. Although the Obama administration has renounced the language of the ,War on Terror' and taken steps to revoke aspects such as water-boarding and the detention facility at Guantanamo Bay, the bulk of the legislation and practices associated with the post-9/11 global security framework remain. The cluster of papers which follow provide detailed studies of the effects of the War on Terror regime on civil society in four contexts: the USA, Spain, Kenya and Uzbekistan. In this way it lays a basis for civil society actors and aid agencies to reflect more strategically on how they should engage with security debates and initiatives in a way that best protects the spaces of civil society and the interests of minority and vulnerable groups. This introduction sets out the three key themes pursued throughout the cluster articles, namely, the selective impact of counter-terrorist measures on civil society; the particularity of civil society responsiveness to these measures; and the role of aid and diplomacy in pursuing security objectives and its consequences for civil society. Civil Society Development Versus the Peace Dividend: International Aid in the Wanni

Donors that provide aid to the Wanni region of Sri Lanka, which is controlled by the Liberation Tigers of Tamil Eelam (LTTE), are promoting initiatives that seek to advance the national peace process. Under the rubric of post-conflict reconstruction, the actions of political forces and structural factors have led to the prioritisation of two different approaches to peace-building: community capacity-building projects; and support for the ,peace dividend'. Both of these approaches face challenges. Cooperation with civil society actors is extremely difficult due to intimidation by the LTTE political authority and the authoritarian nature of its control. Peace-building successes with respect to the peace dividend are difficult to measure, and must be balanced against the negative effects of misdirected funds. Aid organisations must be careful not to consider the tasks of peacebuilding, humanitarian relief and community empowerment as either interchangeable or as mutually reinforcing endeavours. [source]


East Timor Emerging from Conflict: The Role of Local NGOs and International Assistance

International assistance efforts have represented a conundrum for East Timorese seeking to assert their new independence and autonomy. While urgent needs have been met, local participation, involvement and capacity building have not been given adequate attention. This outcome is aptly demonstrated in the case of local non-government organisations (LNGOs). This paper specifically examines the role of LNGOs in the recovery of East Timor within the international assistance programme. It examines the challenges of rehabilitation efforts in East Timor with a particular focus on capacity building of East Timorese NGOs as part of a broader effort to strengthen civil society. The initial crisis response in East Timor highlighted tension between meeting immediate needs while simultaneously incorporating civil society actors such as NGOs and communities. It has been argued that local NGOs and the community at large were not sufficiently incorporated into the process. While it is acknowledged that many local NGOs had limited capacity to respond, a greater emphasis on collaboration, inclusion and capacity building was desirable, with a view to supporting medium and longer term objectives that promote a vibrant civil society, sustainability and self-management. Sustainable development and the ,governance challenge': the French experience with Natura 2000

Abstract Sustainable development is conceptualized in this paper as a serious challenge for governance structures and processes in nation states. Global and European agreements have placed the inclusion of civil society actors in policy-making at the heart of the sustainability agenda. This commitment is particularly evident in the Commission's White Paper on Governance and the EU Sustainable Development Strategy. From this perspective, the European Commission has consistently underlined the integral role of dialogue with social partners in any sustainability agenda. In contrast, there is a clear mismatch between these principles of civil society inclusion and policy-making in France. Long-standing traditions of meso-corporatism have struggled to adapt to extending participation to civil society actors. This paper assesses the implementation of sustainable development as civil society inclusion with reference to the French experience in dealing with EU biodiversity policy. It is argued that this governance challenge has effectively presented nation states with an ,interpretation dilemma' with regards to sustainable development. Who inhabits the European public sphere?

This article investigates which actors profit from and which actors stand to lose from the Europeanisation of political communication in mass-mediated public spheres. Furthermore, it asks to what extent these effects of Europeanisation can help one to understand collective actors' evaluation of European institutions and the integration process. Data is analysed on some 20,000 political claims by a variety of collective actors, drawn from 28 newspapers in seven European countries in the period 1990,2002, across seven different issue fields with varying degrees of EU policy-making power. The results show that government and executive actors are by far the most important beneficiaries of the Europeanisation of public debates compared to legislative and party actors, and even more so compared to civil society actors, who are extremely weakly represented in Europeanised public debates. The stronger is the type of Europeanisation that is considered, the stronger are these biases. For most actors, a close correspondence is found between how Europeanisation affects their influence in the public debate, on the one hand, and their public support for, or opposition to, European institutions and the integration process, on the other. Transnational political action and ,global civil society' in practice: the case of Oxfam

Abstract The term ,global civil society' has taken on increasing significance within scholarly debate over the past decade. In this article we seek to understand transnational political agency via the study of a particular transnational actor, Oxfam. We argue that various schools of thought surrounding the global civil society concept, in particular the prevailing liberal-cosmopolitan approach, are unable to conceptualize transnational political action in practice , due largely, in the case of liberal-cosmopolitanism, to a shared normative agenda. We also assess what contribution literature on development and civil society has made to the analysis of groups such as Oxfam. In investigating Oxfam's own perceptions of its context and the meanings of its agency, we discover an anti-political perspective derived from an encounter between Oxfam's longstanding commitment to liberal internationalism and globalization discourse. Existing scholarship has insufficiently identified the local or parochial nature of the identities of global civil society actors. [source]


Networks of Trade Protest in the Americas: Toward a New Labor Internationalism?

ABSTRACT In the mid-1990s, for the first time in the history of the Americas, truly hemispherewide collaboration among labor organizations became possible. Yet this new political opportunity structure has not brought actors together in an undisputed new labor internationalism. This article focuses on two key sources of contention among labor organizations in the context of free trade mobilizations between 1990 and 2004: the discussions about coalition building with other civil society actors and the debates about including a social clause in trade agreements. It argues that transnational collective action occurs parallel to the continued relevance of national-level claims and targets, and that this simultaneity represents a real source of challenges, for scholars and labor organizations alike. Based on social network data and qualitative interviews in Brazil, Mexico, Chile, and the United States, the article analyzes the actions taken by labor organizations, and how these changed through time. The Indian Movement and Political Democracy in Ecuador

ABSTRACT This article examines the implications of the Ecuadorian Indian movement for democratic politics. During the 1990s, the movement successfully fostered indigenous and popular participation in public life, influenced government policies, and became a contender in power struggles. But in the institutional domain, the participatory breakthrough had mixed effects. While the movement fulfilled functions of interest representation and control of state power, its involvement in a coup attempt demonstrated that its political socialization had not nurtured a sense of commitment to democracy. The evidence is discussed by reference to the proposition that civil society actors may or may not contribute to democracy. The article argues that the study of the democratic spinoffs of civil activism requires a context-specific approach that considers the particularistic orientations of civil associations and pays attention to their definition of means and ends, the institutional responses evoked by their initiatives, and the unintended consequences of their actions. Judicial Activism in Perilous Times: The Turkish Case

Under what circumstances do courts act in ways that challenge the political hegemony of the military in countries with weak democratic institutions? This article addresses this question by focusing on a critical case of judicial activism in Turkey. It argues that lower courts unexpectedly can be centers of judicial activism that contributes to expansion of civil liberties and restrictions on arbitrary state power when the high judiciary supports the political status quo. This is because lower courts provide greater access to legal mobilization pursued by civil society actors. At the same time, judicial activism in lower courts is sustainable only when political power is distributed among elites with conflicting interests, and the civilian government offers support and protection to activist members of the judiciary.
